Defense: No Evidence of Rape in Killing of Bible College Student

Elizabeth "Bipsy" Kellenbarger Amirian suffered no injuries that support the accusation she was raped before being allegedly stabbed to death by her fiancee in a Promenade mall parking garage, the defense claims today.

No evidence supports the charge that a former Calvary Chapel Bible College student was raped before she was stabbed to death, a forensic pathologist testified today.

Aaron Gleckman, the pathologist, testified at the Southwest Justice Center in French Valley during the trial of Mickey David Beauchamp Wagstaff, 27, of Pala.

The defendant was accused of imprisoning, raping and killing 27-year-old Elizabeth "Bipsy" Kellenbarger Amirian on Feb. 12, 2009, in a van at the Promenade mall's parking structure. To read about what allegedly happened, .

A photo was projected on a screen for the jury during a hearing today that showed the cuffs of a blue long-sleeved shirt tied around the victim's ankles. This is how deputies found Amirian, testified detective Michael Callahan today.

One of the sleeves was tied only loosely around one ankle, Gleckman testified, and her wrists were free when her body was found.

Also, neither her wrists nor her ankles were bruised from being bound, and an autopsy revealed no physical trauma caused by a rape, he said.

The defendant told investigators he tied her up and raped her several times before the killing, according to evidence and testimony presented during previous hearings. To read about what he said, .

The lack of evidence does not necessarily mean she was not raped, the pathologist stated. "The medical literature shows the vast majority of times when a man or woman is raped, it doesn't leave any injuries on the body," he said.

The charge stems from the defendant's admission during interrogations that he raped the victim.

Wagstaff and the victim were undressed together at one time when he asked her if she would like to have sex. She told him no, they should wait until they were married, the defendant told an investigator during a recording played for the jury during an earlier hearing.

He had sex with her anyway, though she did not put up a fight, he told an interrogator.

Wagstaff, who attended Murrieta Springs Seventh-day Adventist Christian Church, implied he was possessed by an unseen force when he killed the victim. To read about what he said,
