Absolute Power Corrupts Absolutely

The authority of the states legislatures to overrule the Supreme Court is discussed in the Thomas Woods video on the Principle of Nullification.

In 1887 Lord Acton proclaimed that "Power tends to corrupt and that absolute power corrupts absolutely." With this in mind it is easy to understand that as the central government gained greater and greater power it became progressively more and more corrupt.

The Framers of the Constitution understood this principle and created the new government with the states having sovereignty over the national government. They knew that if the government that they had created was not constrained it would one day enslave the people that it was created to protect.

Restoring the sovereignty of the states over the national government is the single most important thing that we can do to restore our Constitutional Republic.

In 1801 the Supreme Court ruled in Marbury vs. Madison that "Any law that is repugnant to the Constitution is null and void." If the states were to assert the rights guaranteed to them under the 10th Amendment, they would become the final arbiter of the constitutionality of all Congressional legislation.

The Supreme Court does not have the Constitutional authority to interpret the Constitution. That is why their decisions are called opinions and are only binding if the state legislatures give their consent.
