Man Pleads Not Guilty in Double Rape of Murrieta Woman

Frank Wyatt Kelly, 38, pleaded not guilty Tuesday to allegedly raping a Murrieta woman twice in the same day.

A man who allegedly raped a 60-year-old woman twice in her Murrieta home pleaded not guilty today.

Frank Wyatt Kelly, 38, was arraigned in a courtroom for the during which he was accused of raping the woman twice and robbing her.

His bail was set at $2.02 million by Riverside County Superior Court Judge Elaine Johnson on request of Deputy District Attorney Julie Baldwin.

It was revealed during the arraignment that Kelly owns a home near the woman's Murrieta residence.

Kelly allegedly approached the woman at her home the afternoon of June 13 as she was unloading things into her garage, according to Murrieta police Sgt. Phil Gomez.

After helping her unload, Kelly left but allegedly returned and entered her home without permission and raped her, Gomez said. He was also accused of taking money from the victim before leaving.

Kelly allegedly returned two hours later and rang the doorbell, according to Gomez.

"Believing it was a neighbor, the victim opened the door. Kelly entered the residence without permission and again sexually assaulted her," Gomez said. 

He left the victim’s residence later that evening, according to Gomez.

The victim reported the incidents to police the following morning, Gomez said.

"The victim suffered minor injuries and was treated and released from a local hospital," Gomez said.

Kelly was arrested on suspicions of the crimes the following morning as he was leaving his residence in western Murrieta, Gomez said.

Kelly's bail was initially set at $1 million, but Baldwin argued the charges were two "separate, distinct incidents" when asking for the bail to be set at $2.02 million.

Johnson also granted a criminal protective order on behalf of the victim at the request of Baldwin.

Kelly was due in court June 26 for a felony settlement conference, and again on July 2 for a preliminary hearing.
