City's Restraining Order Against Marijuana Co-op Denied by Judge
Greenhouse Cannabis Club on Jefferson Avenue plans to stay open after a judge does not grant a temporary restraining order sought by the city of Murrieta.
A Riverside judge on Friday denied a restraining order sought by the city of Murrieta against a newly-opened medical marijuana cooperative.
The Murrieta City Council on Tuesday in a closed session directed its legal staff to pursue the restraining order as the first course of action in permanently shutting down Greenhouse Cannabis Club. The city has a moratorium in effect on medical marijuana dispensaries.
The city's legal team, including attorney Jeff Morris, went before Riverside County Superior Court Judge John W. Vineyard with the goal of obtaining the restraining order, but came away empty-handed.
Morris told Patch in a phone interview Friday that the judge said their request was "too broad" so he set a hearing for Feb. 17. Morris believes at that time the city will be granted a permanent injunction against the medical marijuana operation.
"This was strictly a preliminary order," Morris said. "The judge would rather just have the hearing."
Morris said the city will continue issuing daily citations to Greenhouse Cannabis Club for being out of compliance with the city's municipal code.
"The city has a moratorium in place on medical marijuana, and plus they do not have a business license," Morris said.
Reached by phone Friday, Greenhouse Cannabis Club Director Eric McNeil said Murrieta police code enforcement officers did not issue him citations on Thursday or Friday at the cooperative located at 26151 Jefferson Ave., Suite A. He had been receiving daily citations of up to $2,500 since opening Jan. 3 after relocating from Lakeland Village near Lake Elsinore.
"I don't think they are able to cite me every day," McNeil said. "The moratorium the city has in place has too many gray areas in it, and a lot of constitutional issues. If they were going to do a moratorium they should have had the people vote on it. The City Council voted based on their own personal beliefs."
Medical marijuana is legal in California. On Thursday, the California Supreme Court agreed to review how cities and counties regulate medical marijuana.
The High Court will review two controversial medical marijuana cases—Pack v. City of Long Beach and City of Riverside v. Inland Empire Patient's Health and Wellness Center., Inc.—then consider whether local governments can ban medical marijuana dispensaries given that the drug is legal under California voter-approved Proposition 215.
The court will also review the continued conflict between state and federal law. Under federal law, marijuana is illegal. The Pack decision held that some dispensary regulations may be preempted by federal law and the Riverside decision held that municipalities can legally ban dispensaries altogether.
As for the city of Murrieta's legal battle against medical marijuana dispensaries, Greenhouse Cannabis Club is the second to open its doors in the city in recent months. Cooperative Medical Group opened in July but was forced to close indefinitely in October when the same Riverside Superior Court judge ruled in favor of an injunction by the city.
Beth Burns, co-owner of Cooperative Medical Group at 26690 Madison Ave., Suite 103, has hired an attorney and filed an appeal. They are due in apellate court later this month.
"We are not stopping until we get a resolution," Burns said in an email to Patch. "Patients have the right to safe access. What better way than a storefront model?
"The new co-op in town is brings the benefit of a long term lease to a building owner. I can run a good, responsible and clean co-op. Spending thousands of dollars on something that is not going to go away is not exactly a smart move."
McNeil agreed.
"Maybe it is time for the city to sit down with some of us co-ops and maybe regulate us," McNeil said.
His attorney, Richard Ackerman, could not be reached Friday for comment regarding the judge's ruling against the city's temporary restraining order.
Ackerman spoke with Patch earlier in the week, when he contended the operation is a nonprofit and is a meeting place for medical marijuana patients. He said the cooperative patients' civil and medical privacy rights were being violated by police scrutiny.
"...You are doing so because you unreasonably believe that you have a right to stop ANY ACTIVITY having to do with the use, possession, advocacy of, sharing of, presence of, or other speech content relating to marijuana," states a notice of rights he advised McNeil to serve to officers when they enter the cooperative.
"You are chilling the free exercise of rights of persons who may or may not be in possession, custody of, bearing a recommendation for, associating with certain persons related to, or just about anyone engaging in First Amendment activities relating to views about medical marijuana," the notice continues.
"Worse yet, you are interfering with our preservation, collection, maintenance and use of evidence against your alleged violations of constitutional law."
Ackerman contended there is no proof that profit is being made at the store.
Morris, on the other hand, diasgreed.
"What is happening is marijuana is being distributed in exchange for cash."

I have a question. Has anyone looked into a lawsuit in the past or currently that these Cities are trying to block our ability to buy our medications, for suppliers to supply the location we buy it from, and are bottom line DENYING us our medications? Identification cards issued to us after a 2 foot stack of medical records is given to them, doctor's appts and perscriptions written by our doctors, any other medical records they wait for from another one of my doctors etc.
The City does NOT have the right to do this. So instead of leaving the co-op alone so we can get our medications, they harrass it and its customers on a daily basis(also demeaning and illegal).
If someone knows of a lawsuit in favor of the patients please let me know. In Private if you wish at Hotincal38@aol.com I am REALLY interested in just HOW the City thinks it is not civilally and criminally at fault for denying us our medications.

I am ANOTHER resident of the city of Murrieta (15 Years) who agrees 100% with LBV Collins. I am a professional, highly educated man who earned a Bachelor of Science with Honors, a Master of Arts Degree, and a Doctorate Degree from UC Riverside, and one who has unfortunately suffered from Osteo-Necrosis for 12 years.
I ONLY get relief from incessant pain and insomnia from legally obtained Medicinal Marijuana a SAFER and non-addictive alternative to Narcotic-Opiod analgesics. As and upstanding, tax-paying resident of Murrieta, I have the legal right to safe and un-harassed access to herbal medicine from LOCAL licensed dispensaries in MY CITY. I cannot drive due to my condition (as many others bed-ridden residents, I must use a taxi for transportation.
City Councel, PLEASE WAKE UP and smell the coffee (or in the case the Marijuana), and realize that the medicinal use of Marijuana is NEVER going to go away! You may delay it temporarily, but in-line with the majority of California Voters (Prop 215), STOP your unreasonable and compassion-less drive to deprive myself and others who need this alternative, homeo-pathic proven remedy for relief from the suffering and pain caused by a wide-range of serious medical conditions, which Medicinal Marijuana provides.

Thank you for contributing to the article Karl. This is the most senseless, costly fight I have ever in my 52 yrs seen anyone continue. I guess just for the sake of winning, otherwise why would they deprive any of us who NEED IT? Its cruel punishment to shut down the area business's so its easier for us to get to. Its cruel and costly to those same business's who go to so much cost and work to get open just to have a huge 100 man task force come in tear your place apart, walls, ceilings, fans, plants, everything apart, just to make a point that "law enforcement is bigger and stronger" and will keep following the rules of the City and County, State and closing your doors.
Very well put Karl and I hope we get some positive soon. Soon its not going to worth it for these people who open a co op to even bother wth it if the FBI, SHERIFF, City Police are going to go in with warrants once a month and a 100 to tow to tear apart their buiness operation, even walls, ceilings, display cases, plants, fans like they did this last bust. They had no reason to break and ruin all of that stuff other then to make a point of DO NOT OPEN again or we will do it AGAIN. Its horrible horrible what all of us are going through. One day, in the not too distant future, we will all look back at what is happening right now, and chuckle. Like Prohibition ( alcohol was illegal), Civil rights ( "whites only" restaurants and bathrooms), interracial marriage ( which was illegal for many years), the topic of marijuana dispenceries will one day be over, and it will be legal. Then, the police and feds can move on to the next hot topic. In my opinion, if tobacco, with all it's dangers of cancer can be made legal, why not marijuana? I've seen plenty of bar room fights with alcohol. I've yet to see any with pot. Grow up, California. It's time to let our adults to be in charge - not out local government.

I agree with that one JJ. I think drinking should be illegal except in the confines of your own home. Not at bars, winery's, dinner, nowhere except home.
That way it doesnt matter what your blood alcohol is, and its always murder 1 for a conviction, life in prison. Make it fast, simple, done with.

Producer members bring it product and other non-producers interested in a variety of marijuana products will come in and acquire what they need. The coop has to pay the farmers, employees, lease, taxes, insurance and the list goes on. They need cash flow. Agricultural Cooperatives due exist!!!!! and they are a legitimate business! The Supreme Court’s review could not have come at a better time. Some cities and counties have used these decisions as an excuse to ban patients’ cooperatives and collectives or to stop existing permitting schemes. The decision to review these cases means they are no longer binding – and there is no legal necessity to ban patients associations, repeal existing regulations, or stall on issuing licenses or permits. The Supreme Court may not rule on Pack or Riverside for a long time (maybe years). Until then, cities and counties are not prevented from upholding the voters mandate in Proposition 215 “to implement a plan to provide for the safe and affordable distribution of marijuana to all patients in medical need of marijuana.”

Once again the law benders or money wasters are both coops who have tried to operate in Murrieta under a false business license for property management or no business license at all. Very clearly deceptive or ignorant to law. I appreciate comments on the money that can be saved by avoiding a fight against still federally illegal drugs and protection of freedoms. But I do not appreciate arrogant disregard to present law. If you want to run a business in Murrieta, get a business license . If you can't get a business license, go to a city where you can. If you don't want to move put down your cheetos and run for office, work to get an official with similar views elected to office, and work to get laws changed.

But I’m trying to remember… when did we citizens have a chance to vote on these laws? To the best of my recollection, we never had the opportunity.
Heck, they’re not really “laws,” are they? They’re city codes created out of thin air and based on… what? Ignorance of Medical Marijuana’s benefits?
I fully appreciate your point, by the way, of actively working to change these codes. But it’s a shame that sick people who are truly suffering and whose doctors recommend that they use medical marijuana are denied safe access. Yep, it’s just wonderful that our City Council decided to ignore Prop 215 and circumvent democracy.
So, Murrieta Resident, I do plan to take action. Next opportunity I have, I’m voting out our current council members.

Jean, and LBV good information in laymans terms so I can grasp all of this from each persons statements.
Like the one simplist is "when did we citizens have a chance to vote on these laws? To the best of my recollection, we never had the opportunity".
This is the root of this problem, and most our problems. We have our minds made up for us when we are born and kept being made up for us so we do not have a clue how to stand up and change anything on our own. This is the simplest statement but the most accurate and our downfall in the USA, ourselves.
Does that make us just like any other group run by a person who wiped out his nation with bombs(pick a way)to take it over and to rule it? or someone who inherited it with a title? Or voted in by peers who get lied to?
The marijuana issue isnt even an issue, as someone said, it costs us so much just to MAKE it an issue for others getting paid to make it an even bigger issue.
Do pros/cons of Marijuana, and is there really a con?.
Unless it might effect the way you drive or use other machinery, maybe we can put that one on the con side? Resolution: Do not smoke and drive if it affects the way you drive. Says that on all my medications, that works.
Maybe I am just a simpleton and recognise how easy it is to keep things simple without all the fighting, negativity, as I see another high powered pain killer hit the perscription pads that make more Veggies out of us, some more then others.

Our opportunity to vote was the vote for elected officials who have the power to direct resources and enforce laws within our city. It is not a perfect system to give a few power that effects many but it is the present system. As these people are elected by the people theoretically if the majority of people agree with their views thenn they stand a good chance of being elected. To my knowledge, and I may be wrong. I have not seen a city council candidate run with a platform to legalize marijuana in this city. I would be curious to see how such a candidate would do. Perhaps Jean or Galactic cannibal or yourself should consider running for City council. Then you will have the chance to vote amongst the council.

The business license issue was reported in the Press Enterprise, the North County times, and the Murrieta Patch.
This is an excerpt from the NC Times
"City records show that in a May application for a business license, Burns marked that she intended to open a "property management" business. In a spot that asks whether said business would deal with drug sales or treatment, Burns marked "no," a copy of the application shows.
Burns was issued a business license for use of Suite 103 at 26690 Madison Ave. in June, according to city records.
However, code enforcement and police officers inspected the business and discovered the business was operating as a marijuana dispensary."
If this is a made up conspiracy where did you learn this and have there been retractions at any of these reporting agencies?

As far as state laws regarding distribution of marijuana, cities are granted the right to "regulate" dispensaries within city limits. The term regulate is highly subjective and certainly needs to be tightened down. As far as federal law Marijuana use is considered illegal and property used for illegal drug related purposes can be seized by federal agents. So is Murrieta above the law. I'd say no we are well within bounds.

City council members and officers are first mandated to uphold the law, I believe that includes federal, state, and city. No one person can possibly represent all people which it is why I suggest working very hard at the next election to get someone you identify with elected.

How many city council meetings have you been to? I feel our council is pretty generous with their time and talents and do the best they can. I have only been to 2 city councils but I was impressed. I have also received responses in writing within 24 hours from the council anytime I have written with concerns. That is also impressive to me. So in this case I feel the statement that "I stand by stupidity" is a little juvenile.
In conclusion the issue to me is not about marijuana it is about obeying laws or not. We have conflicting laws at Federal, state, and city level. Until we align these there will be confusion and it is up to all of us to work towards a solution.

Kingpin, oh so true. That is exactly like it is, no doubt. I, myself, had never thought about the bar fights, domestic fights, etc. and they all did involve alcohol. Alcohol can make many drinking it MAD, ANGRY and over react, and that is before they get full on drunk.
I have never been much of a drinker, oh maybe in my younger days, but even then it wasnt to the point of passing out or not remembering things like my friends. I don't remember ever getting angry and perhaps just because I did not drink enough. Getting a warm feeling to my toes and a lopsided grin on my face was enough for me I guess.

Now Mr. Cannibal,
I never said I did not try shrooms, or marijuana. The shrooms made me so out of it, it took our driver 12 hours to get us home from Big Bear to Orange County and no I do not remember sleeping, then spent a 2 hours trying to get into my house, because getting the keys out of my purse would have been too hard evidently. Don't know, don't remember anything except a roomate telling me I should get out of my 2 hour shower the water was cold, and the small black and white TV I had setting on the edge of the tub might fall in. ****cough***** never tried THAT again. Course with being young, we didnt know that eating a handful of about 20 of those would prolly do that to you. Marijuana I never got used to to drive or function over hours of laughing with tears running down my face wondering why everyone was bothering to talk if they couldnt finish a sentence. Hmm...thank god I never ended up on a planet I would probably still be stuck there. LOL I am 52 so I was only a baby hippy back then. But now with my slew of medical problems..........alternatives do exist that dont kill you like some of the meds I am on.

Now cities like Murrieta will be unable to use appellate court decisions to deny patients access to medical marijuana in their own communities. The Pack decision of last year created a hell of a mess!

* It has grossly escalated Murder, Kidnapping, Extortion, Theft, Muggings and Burglaries.
* It has diverted scarce law-enforcement resources away from protecting citizens from the ever escalating violence against their person or property.
* It has overcrowded the courts and prisons, thus making it increasingly impossible to curtail the people who are hurting and terrorizing others.
* It has evolved local gangs into transnational enterprises with intricate power structures that reach into every corner of society, helping them control vast swaths of territory while gifting them with significant social and military resources.
Imagine if we were to chop down every single tree on the planet as a response to our failure to prevent tree-climbing accidents. That's what our misguided drug policy looks like. Isn't it time we all stood up and told the government we're tired of being beaten and jailed so that pharmaceutical companies can poison and kill us for obscene profits?

That is totally off. The only people who want to live in the western world are the wretched ,who like the wretched what came to our country a couple hundred years ago.
I you travel on business in CHINA and India and Korea an I do . You will find their growing and massive middle class have no desire to live in the West. Their middle class have a combined combination that is 3 times our entire population..
And Corporate America and Corporate Europe are rushing headlong into those countries to make more profit at the cost of our middle class loosing jobs..

The Elected "Best Government Money Can Buy", clown takers. Should take a vote of our California Peace Officer's. Those on the front line safe guarding law and order, with out them there we would have anarchy in the streets. They really are our good neighbor's.
